CareReq Cancellation and Refund Policy

We encourage you to read and understand this cancellation and refund policy (the “CareReq Cancellation and Refund Policy” or this “Policy”). By accepting the Terms and/or the CareReq Cancellation and Refund Policy, you represent that you have read and agreed to the terms of this Policy. This Policy is incorporated into and subject to our Terms.

All capitalized terms that are not otherwise defined herein obtain their meaning from the Terms. If you do not agree with this Policy or any other provision in the Terms, you may not Site or Applications, as defined in the Terms. CareReq reserves the right to change or modify any of the terms and conditions contained in this Policy at any time and in its sole discretion, in accordance with Section 20(b) of the Terms.

1. Cancellations and Refunds

  1. Cancellation by the Provider. The Provider may cancel their response to a Client’s request without any penalties imposed by CareReq. CareReq bears no responsibility or liability in the event that such cancellation causes any damages to the Client. The Provider acknowledges that the Client may have a claim against the Provider for any direct damages the Client sustains due to such cancellation by the Provider. Upon cancellation by the Provider, the Client’s request will be placed again in the pool of requests for other Providers to accept.
  2. Disabling and Reinstating Provider Account by CareReq. If the Provider cancels over three (3) accepted requests, CareReq reserves the right to disable the User Account. The Provider can email CareReq at contact@carereq.com to request the reinstatement of their User Account. CareReq can deny such reinstatement in its absolute and unfettered discretion without any obligation to offer any reasons for its decision. CareReq may request and the Provider undertakes to provide any proof requested by CareReq showing that the Client requests, that were initially accepted by the Provider, were subsequently cancelled due to extraordinary circumstances.
  3. Cancellation by the Client Prior to Acceptance of the Request and Refund. The Client may cancel their request at any point if the request has not been accepted by a Provider. In such case, the Client will be refunded the amount they paid for the services, minus the transaction fees of 3.5% on the total amount paid by the Client including applicable taxes (“Cancellation Processing Fee”). For clarity, the transaction fees charged by CareReq in this case include fees imposed by third party providers that CareReq may use from time to time.
  4. Cancellation by the Client After the Acceptance of the Request and Refund. If the Client’s request has been accepted by a Provider, the timing of the Client’s cancellation in reference to the time the services have been scheduled to be rendered at, will determine the percentage of the Fees, as defined in the Terms, the Client will be refunded. The difference shall be paid to the Providers for the Client’s late cancellation, minus CareReq’s Cancellation Processing Fee. For clarity, the Client’s refund shall represent the balance minus the charges described below.
    1. If the Client cancels the accepted request in less than 2 hours from the time such services were scheduled to be rendered at, the Client shall be charged be 75% of the Fees in addition to the Cancellation Processing Fee.
    2. If the Client cancels the accepted request between 48 hours and 2 hours from the time such services were scheduled to be rendered, the Client shall be charged 100% of the hourly rate selected by the Client in addition to the Cancellation Processing Fee
    3. If the Client cancels the accepted request earlier than 48 hours from the time such services were scheduled to be rendered, the Client shall be charged 50% of the hourly rate selected by the Client in addition to the Cancellation Processing Fee.
  5. Payment Processing. Users may be required to provide a credit card, other payment and/or banking information when registering for a User Account. Your credit card, payment and banking information will be maintained and processed, when necessary, by our third party payment provider. You acknowledge and agree that our third party payment processor’s terms will govern your agreement and interactions with them and that we have no liability arising from your use of or access to their payment processor. You agree to review our third-party payment processor’s terms and policies. CareReq reserves the right to switch payment processing vendors in its discretion.
  6. Discretionary Refunds. We may, in our sole discretion, on a case-by-case basis, issue a refund or partial refund for any fees you pay us to access or use CareReq when we believe it is warranted.
